Global Tracks, Inc. (herein after GT) and Professional Education Society (herein after PES) located at 1306 Fortino Blvd., Pueblo, CO 81008, in return for full payment by you for the amount specified is responsible to arrange for the transportations, accommodation and other services specified in promotional materials and/or contract(s) and subject to the following terms and conditions. Unless expressly specified as included; other services, taxes and fees are not included. GT/PES and other partners act only as agents for the passenger in regard to travel whether by motorcar, motor coach, ship, train, or airplane and assume no liability for injury, damage, loss, accident, delay or irregularity which may be occasioned either by reason of defect in any vehicle or for any reason whatsoever, or through the acts of defaults of any company or person engaged in conveying the passengers or in carrying out the arrangements of the program. Passengers waive all claims against GT/PES who do not own, manage, and control or operate any transportation vehicle, hotel or restaurant or any other supplier of services. GT/PES may, where circumstances outside of its control affect the provision for travel arrangements (such as weather, flood, fire, act of God, war or threat of war, physical unrest, riots, civil disturbances, threatened or actual terrorist activities, strikes, port or airport closure, technical problems with transport, alteration or cancellation of scheduled travel services), cancel scheduled travel arrangements and may at GT/PES’s sole and absolute discretion: (a) offer the client alternative travel arrangements of comparable standard as may be appropriate in the circumstances; or (b) if alternative travel arrangements are not offered by GT/PES, they will refund monies paid by the passenger to the extent that it is possible to obtain refunds from airlines, hotels, ground operators and other travel providers prepaid on behalf of the passenger, taking into account the extent of the travel arrangements that have been provided or arranged. GT/PES may charge a reasonable fee to cover the administration costs associated with providing alternative travel arrangements. Passengers shall not be at liberty to maintain a claim for compensation from GT/PES or otherwise for any loss arising as a consequence of said curtailment, alteration, extension or cancellation of the tour. The right is reserved to change any air schedule or arrangements should conditions necessitate; to offer substitutions of equal value; or to cancel the operation of any scheduled service. The right is also reserved to decline to accept or retain any person as a member of any party at any time. In such event, an equitable refund will be made. GT/PES reserves the right to cancel any tour prior to departure, in which case full refund will constitute full settlement with the passenger. No refund will be made for any unused portion of the tour unless arranged prior to departure. The issuance and acceptance of vouchers/tickets shall be deemed to be consent to the above conditions. The airlines and their agents and affiliates are not to be held responsible for any act or omission, or even during the time passengers are not on board their aircraft. The issued passenger ticket shall constitute the sole contact between the airlines and the purchaser of these tickets and/or the passenger. Persons who may be physically or mentally challenged should seek approval of their physician prior to traveling. Although not anticipated, GT/PES may increase prices prior to departure due to increases in suppliers’ prices, or changes in the currency exchange rate. A deposit confirms a reservation and indicates the passenger’s acceptance of these terms and conditions, cancellation and refund policy. Once issued, and prior to departure air tickets are nonrefundable. After scheduled flight departure, unused tickets and portions of tickets are nonrefundable. Names are required as they appear on the passenger’s passport. Name changes may result in penalty charges. GT/PES cannot be held responsible for airline delays. Aircraft boarding privileges are limited to persons whose full payment and signed agreement has been received by GT/PES. All persons must also present a passport with at least 6 months validity and positive proof of identity when boarding. Improper documentation, inadequate proof of identity may result in denial of boarding privileges. All persons are responsible to have any necessary visas required. If GT/PES is to assist with acquiring visas, they cannot be held responsible for any last minute visa policy changes by a foreign consulate. If you are denied boarding privileges, you forfeit all monies paid and will be assessed any non-recoverable costs.
